Very Important to Read !!!

The Confusion and Truth about Dan's unfortunate Departure ....  It is a bit lengthy but worth perusing...

from the writer of the "out of context" blog entry that allegedly caused the departure of Dan  ....M Ibing

It appears that residents following this blog have begun to wonder what really happened or making assumptions that certain information posted on this blog may have been a cause for Dan's departure.   

For the record, the information posted was extracted and isolated from the context of an exchange of a mixed bag of information spanning several Anasazi related subjects  email messages and maybe was posted with poor judgment ?? ..by the blog master.   That unfortunately is now history and cannot be undone.

What can be undone however is the misperception about what can and cannot be used, legally that is, for causing a termination of employment.  For purposes of this discussion, any information made, posted, or otherwise published by a third person about another person, through this blog for example, or made by an editor of the Arizona Republic, or a TV News person for that matter, cannot be used as a cause of termination - it is and remains hearsay so to speak.  

As a result, what Wayne and his AAM HR staff would like you and me to believe regarding Dan's departure, namely the out of context note posted on the blog, has no legal bearing whatsoever.  It cannot be used as a cause for termination, it is hearsay, no more, and hearsay is not a cause. 

****Wayne and the AAM HR person aiding Wayne in this case reportedly had a restless night after their decision to let Dan go because both of them know that neither had nor have a case or cause for termination based on hearsay. ********* 


***They are correct to worry and likely have some more restless nights, because this case is far from being over.


To add to the confusion we need to note that there is another common misinterpretation for causes for termination and that deserves to be corrected is the reference to "Arizona is a Right To Work State" following which, as many people wrongfully believe, one can be fired from one's job without explanation.  That is entirely wrong.  The statutes relating to Right to Work in Arizona can be found in Arizona Revised Statutes Title 23-1301 through 1307.

As a consequence, one has to begin to wonder as to what was the real, legally sound cause - "hearsay" published on the blog, the Arizona Republic and out of context, or not, or a wrongfully interpreted or possibly purposely misused Arizona Statute, intimidation or coercion - so what really was the legally sound cause for termination?  Our infamous BOD should have a vital interest in finding out what "really happened".

We all remember and know that Wayne has been trying from almost "day-one" last year when AAM took over to let Dan go, mainly using late appearance for work, sometime measured in minutes.  Wayne kept, and in all probability still has these "minute" recordings, or they now have been archived at AAM's HR department, for the "just in case, cover the rear need" because they know that there can be, and actually should be, an investigation related to the legality of this termination case. 

Just the record and easily confirmed by most of the Anasazi residents, anytime there was a potable or waste water flooding problem, Dan was the first to arrive in short order, within minutes, identified the problem at hand and applied "first aid".  


Dan, unlike anybody we can point out, knows any and all problem areas of the aging Anasazi complex infrastructure and has been instrumental to not let problems get out of control, sometimes doing so against the instructions of AAM, and Wayne for that matter, but for the better of this community.

The coming days without Dan, especially during the fall, winter and spring months, when the aging and now fragile Anasazi infrastructure is subjected to severe stress is a time that I am not looking forward to.

Dan, including his daughter McKenzie have been and remain what one would call friends with my wife and myself.  Dan and his lovely and vibrant daughter McKenzie visited us the day following the untimely termination and we talked about the absurdity  of what happened the day before.  Dan understood that the posting of the message was unintentional and pulled out of context from a part of a larger message exchange on several subjects and not intended for publication.  

I was saddened having to learn that the blogmaster also has his moments of senior days so to speak allowing for poor judgment, in this case being able and willing to differentiate between a personal exchange of information not intended for publication and information that is well intended and yet may deserve publication. 

In closing my thoughts on this emotional subject, I strongly recommend that all of us consider and call Dan anytime and for any need you may have or are going to have to correct any problem of any kind with your condo or residence outside Anasazi.  


Dan literally lives within minutesof this property and can help you with any and all condo issues.

I dont believe bad judgement was used, You all want truth ?? Then I give it to you and you all Quiver!!  I had 4 comments  I did not publish from Big Mouths who knew it all and Dan was on Vacation...Blahh Blah.....  


Please dont look to shift any blame ..I just state and publish what many residents send to me..AND all are entitled to their opinion.....Thus the meaning of a Blog....But none the less ......This is just another reason for you all to see that this AAM is trying to run this place like communists, They pulled the same story with Syndy 

They came in and wiped out all the good help and Replaced it with a Broke down Management team, A cleaning crew that needs a cleaning itself and the worst landscape company in the Valley according to looking around?...


We have 2 PEOPLE in OFFICE that cant do the job one person did all these years......BOTTOM LINE !! .. 


And then we get the Ms Snotty District Manager (Janice Martinez)  at our Board meetings  to read statues...  Like if we speak we will get in trouble ??   Can sure tell she is a AAM Hire.. You dont scare us Janice.  We snicker !!  You make a fool of yourself at every meeting !!


Who is going to do Maintenance??

Brandon ?? Great Kid ,Very respectful !! But barely knows what  pliers are...TRUTH IS DAN WAS THE BRAINCHILD HERE FOR MAINTENANCE, Along with all the rest that knew this property that are gone ?


SO NOW ASK YOURSELVES ??  If you call emergency line tonight ??  ..Who will respond that will make you feel all better ?? NOT DAN !!! 


WE HAVE NO ONE !!!  WAIT TILL THE WINTER VISITORS ARRIVE

THE TOPPER WAS !!  A couple months ago WAYNE after reading initial blog post before Mr Ibing ever wrote me..  He pulled me in the front office and told me Dan was going Nowhere ...Now I see it was a ploy to keep us off track..And his word is NILL ... Bad Quality Wayne!!!

The bottom line is unless you all band together soon You WILL be stuck with the Management and Board some of you are so proud of ~!!!

This place has gone from Riches to Rags and not heading upward anytime soon

Why is this man still on our property?  
What exactly are we paying AAM, Wayne and Roe to do?  Where is Janet and Izzy's leadership?  Where is Wayne lately?  Who is in control anymore on this property?  Who does the man in the golf cart answer to?

Mr. Webmaster:
Great Letter of explanation to the residents.  If the Board, AAM and this Management Team put as much effort into their jobs and responsibilities as they do into finding ways to get rid of anyone who knows to much (Dan, Frannie, Sindy, Jake) Anasazi would not have fallen off the map of great places to live!
Will Birchmore be at tomorrows emergency meeting?  If he misses this scheduled meeting it will be his third scheduled meeting in a row he has missed.....
The owners should have an emergency meeting with the board demanding AAM and management team are terminated immediately. This board hired AAM and this board can fire AAM immediately.
Reality is no one is on property anymore with any knowledge of the plumbing horrors that await us!  Wayne is very seldom on property anymore and Roe is Roe. No one works here anymore!  Best thing board could do right now is bring old crew back and get some stability and dedication back on this property. We need that permanent staff of people working on the property everyday Pre AAM.
Word is out in the surrounding communities  about how bad Anasazi has become.
